Die Autorin untersucht die emotive Durchdringung des Rechts im Kontext von Transitional Justice anhand der jüngeren strafrechtlichen Aufarbeitung der Diktaturvergangenheit in Argentinien. Im Fokus stehen kollektive Emotionsdynamiken, die sich in der gesellschaftlichen und juristischen Aufarbeitung im Spannungsfeld efferveszenter Kollektivgefühle, den rationalen Logiken des Rechts und seiner gleichwohl "heiligen" Aura entfaltet haben. Ausgangspunkt der empirischen Betrachtung ist der mehrfach prämierte und dem Buch beiliegende Dokumentarfilm "Algo mío – Argentiniens geraubte Kinder", der die Ambivalenzen einer emotiven Theorie des transitorischen Strafverfahrens in eindrucksvollen Bildern und fesselnden Geschichten zum Ausdruck bringt.

Emotions permeate social life in all its areas. This also applies to law, especially in the context of human rights and the reappraisal of state injustice. The author examines the emotive permeation of law in the context of transitional justice using the recent criminal justice process of dealing with the dictatorship's past in Argentina. The focus is on collective emotional dynamics that have unfolded in the social and legal reappraisal in the field of tension between effervescent collective feelings, the rational logics of law, and its nonetheless "sacred" aura. The starting point for the empirical examination is the documentary film "Algo mío - Argentina's Stolen Children," which has won several awards and is included with the book. It expresses the ambivalences of an emotive theory of the transitory criminal process in impressive images and captivating stories.

Hermeneutik ist die Kunst, fremdes Sinngut zu begreifen und anderen in Worten zu vermitteln. Diese Studien gehen von der juridischen Hermeneutik aus und vergleichen diese mit der biblischen Theologie und der Literaturwissenschaft. Sie alle sind angewiesen auf das Verstehen vorgegebener Texte und auf deren Interpretation. Doch nur Gesetze und biblische Botschaften, autoritative Texte also, können angewendet werden und planmäßig auf die Lebenswelt einwirken. Möglichkeiten dieser Art sind den „schönen“ Texten der Dichtung fremd. Sie folgen einer eigenen, ästhetischen Gesetzlichkeit. Der identische Text kann sich unterschiedliche Deutungsmöglichkeiten offen halten. Diese sind allerdings nicht unbegrenzt. Die Hermeneutik ist auf Wahrheit ausgerichtet. Doch dies ist die Wahrheit über den vorgegebenen Text, die unabhängig davon ist, ob der Text selbst wahr ist oder nicht.

Hermeneutics is the art of understanding foreign meaning and communicating it to others in words. The present studies take their point of departure from juridical hermeneutics and compare them with biblical theology and literary studies. They all depend on understanding given texts and interpreting them. But only laws and biblical messages, authoritative texts that is, can be applied and have a planned effect on the life world. Possibilities of this kind are foreign to the "beautiful" texts of poetry. They follow their own aesthetic legality. The identical text can keep open different possibilities of interpretation. These, however, are not unlimited. Hermeneutics is oriented towards truth. But this is the truth about the given text, which is independent of whether the text itself is true or not.

The role of narratives in legal contexts has been explored in multidisciplinary research for several decades. Much has already been said and written about the part of Max Weber’s Wirtschaft und Gesllschaft that has become known as "legal sociology". However, the edition of the texts in the context of the historical-critical Gesamtausgabe, which is now available, and the insights gained in the editing work give cause to question established interpretations as well as to put new interpretations of these multi-layered texts up for debate. Thus, these texts already contain approaches to a pluralism of normative orders, and Weber also emphasizes the cultural dimension as a difference in the legal systems in a way that still seems significant for observations of contemporary societies and their images of identity. This volume brings together contributions that have been written against this background and in the course of a renewed examination of Weber's writings on law.
